Prosecutors in Bloomington are asking a judge not to set aside a man’s 1991 conviction for killing his father. The McLean County State’s Attorney’s office yesterday said there’s not enough evidence to call Don Whalen’s conviction into doubt. But the judge ruled last month that Whalen deserves at least a second trial, if not freedom, because of questions about the evidence against him. Prosecutors say the questionable DNA evidence is still somewhat reliable.
