A new bill in the Illinois Senate meant to close a loophole which allows police officers to have sexual intercourse with detainees. State Sen. Toi Hutchinson (D-Chicago Heights) said Illinois is one of 34 states which allows officers to “evade sexual assault or rape charges by claiming that sexual activity with someone detained or in custody is consensual.” The bill would expand the definition of custodial sexual misconduct to include law enforcement officers who engage in sexual activity with a person in police custody. The bill passed the House and is now heading to the full Senate.
